Terms of Service

Agreement

By creating an account or using CaféOS (“the Service”), you agree to these Terms of Service (“Terms”) with CaféOS Dev, India (“CaféOS”, “we”, “us”). If you do not agree, do not use the Service.

The service

CaféOS is an AI-powered management platform for cafés and restaurants. It provides menu analysis, revenue insights, reputation tracking, demand forecasting, customer win-back automation, and social media tools. Features are delivered as described on the pricing page at the time of your subscription.

We may update, add, or remove features. We will give you at least 30 days' notice before removing a feature that is core to the plan you are on.

Accounts

  • You must provide accurate information when registering.
  • You are responsible for maintaining the security of your account credentials.
  • One account may manage multiple cafés. Each account belongs to one person or legal entity.
  • You must be at least 18 years old to use the Service.

Subscription and billing

CaféOS offers a Free plan and a Pro plan. Pro is billed monthly or annually via Razorpay.

  • Current Pro pricing — ₹1,999/month (monthly) or ₹1,499/month billed annually. Pre-launch pricing (₹999/month) is available to the first 20 subscribers and is subject to change when the pre-launch offer closes.
  • Billing date — your subscription renews automatically on the same date each month (or year). Razorpay will charge your saved payment method.
  • Cancellation — you may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused days.
  • Failed payments — if a payment fails, your account will be downgraded to the Free plan after a 7-day grace period. You can reactivate by updating your payment method.
  • Taxes — prices are exclusive of GST where applicable. GST will be added at checkout as required by Indian tax law.

Your data

You own the business data you upload to CaféOS — menu files, sales CSVs, review text, and customer records. You grant us a limited licence to process this data solely to provide the Service to you.

We do not sell or share your business data with third parties for advertising or competitive purposes. See our Privacy Policy for full details.

You are responsible for ensuring you have the right to upload customer phone numbers and send WhatsApp messages to them. You must comply with TRAI regulations and WhatsApp's Business Policy when using win-back messaging features.

Acceptable use

You agree not to:

  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.
  • Use the Service to send unsolicited commercial messages (spam) to customers who have not consented.
  • Upload content that is unlawful, defamatory, or infringes third-party intellectual property rights.
  • Resell, sublicense, or white-label the Service without our written permission.
  • Attempt to overload or disrupt the Service through automated scraping, denial-of-service, or similar means.

We may suspend or terminate accounts that violate these terms without prior notice.

AI-generated content

CaféOS uses large language models (Claude by Anthropic) to generate reports and recommendations. AI-generated content is provided for informational purposes only. It does not constitute professional financial, legal, or business advice. You are responsible for verifying recommendations before acting on them.

AI outputs may occasionally be inaccurate or incomplete. We work to improve accuracy but cannot guarantee that all AI-generated content is correct.

WhatsApp and messaging

Win-back messages, prep push alerts, and other WhatsApp automations are delivered via Interakt (a Meta Business Solution Provider). You are responsible for:

  • Registering the required Interakt message templates before activating automations.
  • Ensuring customers have consented to receive WhatsApp messages from your café.
  • Honouring opt-out requests from customers. CaféOS provides opt-out tracking, but you are responsible for compliance.

Limitation of liability

To the maximum extent permitted by applicable law:

  • CaféOS is not liable for indirect, incidental, or consequential damages arising from your use of the Service.
  • Our total liability to you for any claim arising from these Terms or the Service is limited to the subscription fees you paid in the three months preceding the claim.
  • We are not liable for losses arising from third-party service outages (Razorpay, Interakt, Anthropic, Meta Graph API, etc.).

Service availability

We aim for high availability but do not guarantee uninterrupted service. Planned maintenance will be communicated with reasonable notice where possible. We are not responsible for downtime caused by third-party infrastructure (Railway, Supabase, Upstash).

Termination

You may delete your account at any time from account settings. We may terminate or suspend your account if you violate these Terms, fail to pay, or if we cease to operate the Service. If we close the Service entirely, we will give at least 30 days' notice and offer a prorated refund for prepaid annual subscriptions.

Intellectual property

CaféOS and its AI-generated report formats, UI, and branding are our intellectual property. Nothing in these Terms grants you ownership of our software or content. You retain full ownership of the business data you upload.

Governing law

These Terms are governed by the laws of India. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of Delhi, India.

Changes to these terms

We may update these Terms. Material changes will be communicated by email at least 14 days before taking effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
